Terms and Conditions for Area2Area Assisted Living Homes

Welcome to Area2Area Assisted Living Homes (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, including any content, features, forms, and tour-request functionality made available through the website (collectively, the “Site”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Purpose of the Site

The Site is provided for general informational purposes only, including to help visitors learn about Area2Area Assisted Living Homes, review our services, contact us, and request or schedule a tour.

Use of the Site does not create any residency agreement, care agreement, medical provider-patient relationship, or other contractual relationship between you and the Company. Any admission, residency, or care services will be governed only by separate written agreements, assessments, and approvals, if applicable.

2. Eligibility

You may use the Site only if you are at least 18 years old and legally able to enter into binding agreements. If you use the Site on behalf of another person, including a prospective resident or family member, you represent that you have authority to do so and to provide any information you submit.

Information on the Site about services, accommodations, staffing, amenities, or care is subject to change without notice. Submitting an inquiry or requesting a tour does not guarantee tour availability, room availability, admission, eligibility, or acceptance into any program or residence.

Admission decisions, if any, are subject to our separate intake procedures, assessments, legal requirements, and written agreements.

12. Limitation of Liability

To the fullest extent permitted by law, Area2Area Assisted Living Homes and its owners, officers, employees, agents, affiliates, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Site.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US $100.00).

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Area2Area Assisted Living Homes and its owners, officers, employees, agents, affiliates, contractors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or relating to:

your use of the Site;

your violation of these Terms;

information you submit through the Site; or

your violation of any law or the rights of any third party.

14. Dispute Resolution

We want to resolve concerns fairly and efficiently. If any dispute, claim, or controversy arises out of or relates to these Terms or your use of the Site, the parties agree to the following process:

a. Notice and informal discussion.
Before starting arbitration or filing a lawsuit, the complaining party must send written notice describing the dispute and the requested relief. The parties will then attempt in good faith to resolve the matter informally for at least 30 days.

b. Non-binding arbitration first.
If the dispute is not resolved informally, the parties agree to submit the dispute to non-binding arbitration in California before a mutually agreed neutral arbitrator or dispute resolution provider. If the parties cannot agree on a provider, either party may propose a reputable California-based ADR provider.

c. Court if unresolved.
If the dispute is not resolved through non-binding arbitration, either party may then bring the matter in a state or federal court located in California, and each party consents to that jurisdiction and venue.

d. Injunctive relief.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in court when necessary to protect its rights pending completion of the dispute resolution process.

15. Governing Law

These Terms and any dispute relating to the Site or these Terms will be governed by the laws of the State of California, without regard to conflict of law principles.

16. Changes to These Terms

We may revise these Terms from time to time by posting an updated version on the Site. The updated Terms will become effective when posted, unless otherwise stated. Your continued use of the Site after changes are posted means you accept the revised Terms.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Area2Area Assisted Living Homes regarding your use of the Site and supersede any prior understandings relating to that subject matter.
